By creating a Swipe Singles account, whether through a mobile application, website, mobile device, or computer (as a whole, the "Service"), you agree to be bound by (i) these Terms of Use, (ii) our Privacy and Cookie Policy, Arbitration Methods (if any applicable to you), and Safety Guidance, each of which is integrated with references into this Terms of Use, (ii) our Privacy and Cookie Policy, Arbitration Methods(if any applicable to you), and Safety Guidance each of which is integrated with references into this Agreement, and (iii) any terms laid out by the firm and agreed to by you for purchase of any additional features, products or services we offer as a Service (collectively, this "Agreement"). If you do not accept and agree to be bound by all of the terms laid out in this Agreement, please do not proceed with the Service.
We may periodically modify this Agreement and our Service. These modifications may occur due to a variety of reasons, including modifications that reflect changes in or requirements of the law, upcoming features, or shifts in business practices. The updated version of this Agreement will be available on our website and mobile application, and you should regularly check for the updated version of our terms and conditions. The recently updated version is the one that will be applicable to you. If the modifications comprise material changes that impact your rights or obligations, we will notify you at least 30 days prior to such changes (except if we’re unable to do the same due to the applicable law) by fair means, which may comprise notification sent by email or through the Service. If you carry on and use the Service even after the activated changes, then we deem that you have agreed to the revised terms of this Agreement.
You cannot be considered authorized or eligible to create an account or access our service unless you meet all of the following prerequisites:
To use SwipeSingles, you may register and sign in through various methods, including Google account login or other ways. By choosing any of these methods for login, you consent to our access and use of your account information, including but not limited to your publicly displayed information. To further understand how we collect your personal data, what sort of data we collect, and how we may use the same, you can run through our Privacy Policy.
You are deemed responsible for the maintenance of the confidentiality of your login details that you input at the time of signing up to your SwipeSingles account, and you are exclusively responsible for all the undertakings that occur through your account. If you are doubtful that someone has acquired access to your SwipeSingles account, you can immediately reach out to our support team.
SwipeSingles constantly attempts to enhance its service and bring you further useful and engaging functionalities to improve your user experience. This implies that we may introduce new enhancements and functionalities or remove some functionalities as and when we deem appropriate, and if any of these changes do not materially influence your obligations or rights, then we may not render a notice before taking such actions. We hold the right to suspend your service in entirety, in which case we will disclose the same to you in advance, unless the suspension has occurred under extenuating circumstances, including but not limited to safety and security issues, the scenarios that would prevent us from doing so.
The most straightforward account termination option remains accessing the "settings" option on our platform. However, you do retain the right to use other account termination methods.
SwipeSingles holds the right to terminate your account at any given point in time, without prior notice, if there is reason to believe that you have violated any terms of this agreement. On terminating your account, you will no longer be entitled to any renewal of service.
For the users residing in the Republic of Korea or other countries where, other than the case where we rationally deem that (i) sending out the notice is lawfully prohibited (including instances when sending out the notice would either breach the applicable laws, orders, or regulations passed by the regulatory bodies or disrupt a proceeding investigation carried out by the regulatory authority) or (ii) giving out any notice would result in harm to SwipeSingles, our affiliates, you, and third parties (similar to instances where sending the notice would deteriorate the security of the service), we will without further holdup notify you of the basis for taking such action.
Once your account is terminated, the terms of this Agreement will stand terminated, except for the provisions that will continue to remain active and applicable to you and SwipeSingles (Section 4, Section 5, and Sections 12 to 19).
Although there are features in place that only permit members to communicate after they have both expressed interest in one another, helping SwipeSingles promote a respectful member experience, the firm cannot be held responsible for any member's actions on or off the service. You consent to exercising caution when interacting with other members, especially when connecting with them outside of the Service or meeting in person. Moreover, before signing up for the Service, you admit to having read and agreeing to abide by SwipeSingles' safety recommendations. You acknowledge and accept that transferring money to other members through wire transfer or another mode requires the disclosure of your financial data (such as credit card or bank account information).
You are solely accountable for your engagement with other members on the platform. You admit that SwipeSingles does not inspect the backgrounds of its members or perform criminal background verifications on them. SwipeSingles does not warrant or represent the behavior or compatibility of its members.
SwipeSingles hereby grants you a non-exclusive, personal, worldwide, revocable, non-assignable, and non-sublicensable license to access and use the Service. This license is given to you just so that you can use and benefit from the Service in the ways that SwipeSingles intended and as permitted by this Agreement. If you engage in any of the following activities, your license to access the Service will be immediately terminated:
In response to unlawful or unauthorized uses of the Service, SwipeSingles may look into the matter and take any appropriate legal action, which may include terminating your account.
Upgrades, updates, or other new features may automatically download and install on any programme that we give you. Your settings on your device may allow for these automatic downloads.
By opening an account, you give SwipeSingles a worldwide, transferable, sub-licensable, royalty-free right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify, and distribute any information that you allow us to access from third parties, such as Facebook, as well as any details that you upload, post, display, or otherwise make accessible (collectively, "post") on the Service or transmit to other members (collectively, "Content"). SwipeSingles’ license to your Content is non-exclusive, with the exception of derivative works produced using the Service, for which SwipeSingles’ license is exclusive. SwipeSingles, for example, would be granted exclusive rights to Service screenshots, including your Content. In order for SwipeSingles to prevent the use of your Content outside of the Service, you also grant SwipeSingles the right to act on your behalf with respect to any illegal uses of your Content received from the Service by other users or third parties. This clearly includes the right—but not the duty—to send DMCA takedown notifications on your behalf if your Content is taken and used by third parties outside of the Service in accordance with 17 U.S.C. 512(c)(3). Our license to your Content is subject to your rights laid down by the applicable law (for example, laws concerning personal data protection laws to the extent that any Content that involves personal information as established by those laws) and is solely for the basis of operating, developing, facilitating, and enhancing the Service as well as researching and developing new ones. You acknowledge that any Content you post or that you give us permission to post on the Service may be seen by other users as well as by anyone else acquiring or using the Service (including users who might acquire shared Content from other SwipeSingles members).
You confirm that the information you provide when setting up an account, including information from your Facebook account, is truthful and accurate. You also represent that you have the legal right to publish the Content on the Service and give the license to SwipeSingles as stated above.
You understand and agree that any Content you submit for publication as part of a Service may be viewed or examined by us. Any Content that, in our sole judgment, violates this Agreement or might damage the Service's reputation may be deleted in its entirety or in part.
You agree to treat our customer care representatives with respect and courtesy in all interactions. We have the right to immediately delete your account if we believe that at any point your conduct towards one of our customer service agents or other employees has been threatening, harassing, or disrespectful.
You agree that we, our affiliates, and our third-party partners, if any, may display advertising on the Service in exchange for SwipeSingles enabling you to use the Service. By giving SwipeSingles recommendations or criticism regarding our service, you consent to SwipeSingles using and sharing that information without paying you anything.
Please be aware that SwipeSingles may access, store, and disclose your account information and Content if obliged to do so by law, to fulfill its contractual obligations to you, or if we have a good faith belief that such access, storage, or disclosure is required to: (i) comply with legal process; (ii) enforce the Agreement; (iii) address claims that any Content violates the rights of third parties; (iv) attend to your requests for customer service; or (v) safeguard the Firm’s or any other person's property, rights, or personal safety.
By proceeding with our Service, you consent that you will not:
If you have broken the terms of this Agreement, misused the Service, or acted in a way that SwipeSingles deems inappropriate or illegal, including through actions or communications that take place on or off the Service, SwipeSingles reserves the right to investigate and/or terminate your account without any prior notice. If you violate any of these rules or our Community Guidelines, your permission to use the Service will be immediately revoked.
Although SwipeSingles reserves the right to review and remove Content that breaches this Agreement, SwipeSingles cannot guarantee that all Content will adhere to this Agreement since such Content is solely the responsibility of the member who posted it. Please use our contact form or the Service to report any Content that you see that is in violation of this Agreement.
When proceeding with any purchase or payment with SwipeSingles, you would be required to provide specific payment details, like details linking to your billing account, credit card, Paypal account, debit card, etc. By carrying on with the purchase or payment, you consent to providing us with all the necessary payment details that are current, complete, and accurate. You also consent to any communication that our payment processing service provider or providers may have with your financial institution through the network token, which is a unique personal identifier that’s referred to during billing procedures, to successfully get your payment through. You agree to pay any valid charges applicable to you or any other person utilizing your account (whether it may be installment charges, any additional fees or taxes leviable on the service offered or purchases made, and/or any further fees connected to the usage of any payment mechanism or channels linking to the purchase).
If you have a payment lined up with SwipeSingles, either linked to your billing account or a debit or credit card, that is declined for any reason, then our payment processor will reschedule the payment automatically until the full amount payable is deducted from your account. However, if these concerns remain unresolved even after reaching out to the account holder and/or card issuer, or if these attempts fail, we will inform you through email, using the same email address linked with your account, and we may further suspend or terminate your SwipeSingles’ account till the pending payments are fully processed.
By signing up for the service, you acknowledge and give consent that we may seek and acquire updated billing details, including but not limited to debit or credit card numbers and/or cards’ expiration dates, from its issuer and that we may update these details in your account and utilize the same for processing of future payments. Additionally, by signing up, you authorize us and our payment processors to record and/or transfer your payment information and other related details as required to enable the processing of payments. You consent to any charges applicable to your purchases, including but not limited to taxes that may be subject to your purchase, which may be subject to change and may differ based on the country of your residence at the time of the purchase. Installment purchases may be subject to a further set of terms and conditions, which will be presented and agreed upon at the time of purchase.
Auxiliary Terms Applicable If You Pay SwipeSingles Directly Via Your Payment Option
If you make a payment to SwipeSingles directly, SwipeSingles will make every attempt to correct any billing problems or mistakes made by it, even if it has called upon or accepted the payment. On initiating a chargeback or reversing a payment processed through your payment method, SwipeSingles may instantly terminate your account at their sole discretion. In case you choose to change or edit your Payment method or details relating to it, you can do so by visiting SwipeSingles’ settings tab.
If a due payment is not successfully processed due to your cards’ expiration, insufficient account balance, or other reasonable grounds, and if you fail to edit or update your Payment information or mode, terminate, or cancel your purchases, you shall remain accountable for the payable amount and allow us to continue seeking the payment from the payment mode updated onto your account. However, this may lead to modifications to the date of purchase.
Virtual Rewards/Items
You may receive or earn a personal, non-transferable, non-sublicensable, limited, revocable license from time to time to use "virtual items," either in the form of virtual products, coins, hearts, or other items interchangeable or usable within the service, in the same nature as that of virtual products (widely referred to as "virtual items"). Any balance made visible to your account, representing virtual items, does not form a part of your real-world balance or carry any stored value; instead, it marks the extent of your license. Virtual rewards or items offered do not incur charges for non-use, but the license extended to you for the use of virtual items may terminate with reference to the terms of this Agreement once SwipeSingles stops facilitating the service or if your account gets suspended or closed.
SwipeSingles, in its sole discretion, holds the right to levy fees when allowing the right to access or use virtual items and may render virtual items with or without any fees. SwipeSingles reserves the right to manage, control, regulate, modify, or eradicate virtual items at any given point in time. SwipeSingles will not have any liability towards you or any third party in the event SwipeSingles exercises any of the above-listed rights. Virtual items will remain redeemable only through the service. All virtual item redemptions and purchases made through the service are final and non-refundable. The allocation of the virtual items or rewards for use in the service is a service that initiates instantly after the recognition and acceptance of your entitlement to the reward or purchase of such a virtual product. You acknowledge that SwipeSingles is not responsible for or required to extend a refund in respect to virtual items or for any other reason, and that you will not be eligible for any reversal of payment or other compensation for unutilized virtual items when an account is closed, regardless of whether the closure resulted due to voluntary or involuntary reasons.

SwipeSingles offers the service "AS IS" and "AS AVAILABLE" and, to the extent sanctioned by applicable law, provides no warranties of any kind, whether express, implied, regulational, or otherwise, in regards to the service (comprising all the content contained therein), including any absolute or implied warranties of satisfactory quality, merchantability, aptness for a specific purpose, or non-infringement.
SwipeSingles makes no representations or warranties that:
(A) The service will be secure, free of errors or interruptions,
(B) Any shortcomings or errors in the service will be remedied, or
(C) Any content or information you obtain on or using the service will be valid.
SwipeSingles is not responsible for any content posted, sent, or received by you, another member, or a third party using the service. Any material downloaded or otherwise acquired through the service is accessed at your own risk and discretion.
The Service may comprise advertisements and promotions presented by third parties and links to other web sites or resources. SwipeSingles is not in charge of the availability (or lack thereof) of any external websites or resources. The third parties’ terms will govern your interactions with them if you wish to get involved with those using our Service. SwipeSingles is not answerable for such third parties' terms or actions.
To the maximum extent permitted by law, SwipeSingles, its affiliates, employees, licensors, or service providers shall not be responsible for any indirect, consequential, exemplary, incidental, special, punitive, or higher damages, including, without any limits, loss of gains, whether suffered directly or indirectly, or any loss of data, use, goodwill, or other insubstantial losses, resulting from:
(I) Your access to or use of, or not being able to access or use the service,
(II) The action or content of other members or third parties on, through, or following use of the service; or
(III) Illegal access, use, or modification of your content, even if SwipeSingles has been advised of the likelihood of such damages.
In no event will SwipeSingles’s combined responsibility to you for all assertions in relation to the service surpass the greater of the amount paid, if any, by you to SwipeSingles for the service and USD100 while you have an account.
Some laws do not permit the exclusion or limitation of some damages, so some or all of the removals and limitations in this section may not apply to you.
Except for members living in the EU or European Economic Area and elsewhere excluded by applicable law:
For members situated in the EU or European Economic Area or elsewhere where our arbitration agreement is barred by law, the laws of the U.S.A., prohibiting US conflict of laws rules, will apply to any disputes originating from or relating to this Agreement or the Service.
Regardless of the foregoing, the Arbitration Agreement in Section 15 aforementioned shall be controlled by the Federal Arbitration Act. The selection of the USA as the governing law shall not replace any mandatory consumer protection legislation in such jurisdictions, for the avoidance of doubt.
Excluding the EU or European Economic Area-based members who can bring claims in their country of residence as per the applicable law and except for claims that may be properly brought in a small claims court of suitable jurisdiction, all claims resulting from or related to this Agreement, to the Service, or to your relationship with SwipeSingles that for any reason are not submitted to arbitration will be litigated primarily in the federal or state courts of U.S.A. You and SwipeSingles authorize the exercise of personal jurisdiction by courts in the USA and reject any claim that such courts are an inconvenient forum.
You agree to indemnify, defend, and hold harmless SwipeSingles, our subsidiaries (if any), and their and our specific officers, directors, agents, and staff from and against any and all concerns, demands, claims, damages, losses, costs, liabilities, and expenses, including attorney's fees, arising out of, relating to, or resulting from your entry to or use of the Service, your Content, or the violation of this Agreement, to the extent permitted by applicable law.
This Agreement contains the entire agreement between you and SwipeSingles regarding the use of the Service, including the Privacy Policy, Safety Tips, Community Guidelines, and Arbitration Procedures (if applicable to you), as well as any terms disclosed and agreed to by you if you purchase additional features, products, or services we offer on the Service.
If any part of this Agreement is deemed to be untrue, the remaining sections will continue in full force and effect. The Company's failure to exercise or enforce any right or provision of this Agreement is not a waiver of that right or provision.
You acknowledge that your SwipeSingles account is non-transferable and that all rights to your account and its Content terminate when you die. This Agreement creates no agency, partnership, joint venture, fiduciary, or other special relationship or employment, and you may not make any representations or bind SwipeSingles in any manner.
